The following terms and conditions govern the sale of tickets to customers for events that Bavaria Klassik carries out in its own name. This includes the event itself as well as all related ancillary services.
These terms and conditions also apply to all future card purchases by the same customer or when using the same password.
I. Special provisions for ticket sales on the Internet
1. Conclusion of the contract
The Bavaria Klassik ticket shop is set up so that customers can buy tickets in a safe way. The presentation of the respective event and its ticket availability does not constitute an offer within the meaning of §§ 145ff BGB and is non-binding.
By submitting an order, the customer declares his binding contract offer.
According to § 312b III No. 6 of the German Civil Code (BGB), ticket orders on the Internet are not subject to the rules on distance selling contracts. There is therefore no right of withdrawal according to § 355 BGB. All orders are therefore final and binding.
a. The customer can choose a password during his order, which he chooses himself.
b. The customer commits not to make this password accessible to third parties or to store it on his computer. Violations occur at own risk. The customer is liable for any misuse.
II. General provisions
The following terms and conditions govern any ticket sale, whether made on the internet or otherwise.
1. Payment arrangements
Tickets can be paid by credit card or debit card, on the internet by direct debit, credit card or Paypal. In the event of a return of direct debit owed by you, Bavaria Klassik will reimburse the return costs of 11 euros to you. These chargeback costs comprise the fees incurred by the respective financial institution and the associated additional expenses.
2. Shipping / Shipping- and system fees
a. Bavaria Klassik will send the ordered tickets to a given address. For postage, packing and processing, the fees shown on the internet during booking will be charged (below 10%).
b. The tickets remain the property of Bavaria Klassik until full payment.
a. The customer is obliged to notify Bavaria Klassik immediately if ordered tickets do not arrive within Germany within 5 working days after dispatch of the order.
b. Claims of incorrectly executed orders can only be made until the beginning of the event and are excluded after this time.
c. Lost tickets will not be replaced.
4. Return of tickets
The return of properly delivered tickets is excluded. Own mistakes of Bavaria Klassik in the execution of orders are corrected according to the valid legal regulations.
5. Relocation / cancellation of events
a. Bavaria Klassik reserves the right to relocate events for an important reason, in particular in case of illness of artists, to other places or days or to offer the customer another event which he himself can choose. Purchased tickets remain valid; a refund is limited to cases where it is unreasonable for the customer to attend the new appointment.
b. If an event is canceled, the entry prices will be reimbursed without shipping costs, postage and system fees upon presentation of the original tickets in exceptional cases in which the customer cannot be reasonably expected to visit the new date.
c. The 3G regulation applies to all Bavaria Klassik events that are related to Covid 19. The buyer undertakes to carry the prescribed documents for RECEIVED, VACCINATED or TESTED with him at the events and to show them on request.
6. Liability / limitation of liability
a. Within the scope of the legal provisions, Bavaria Klassik is liable without limitation for damages resulting from even negligent injury to the life, body and health of the customer. The same applies to the violation of essential contractual obligations.
b. For other damages, the liability for simple negligence of Bavaria Klassik and its legal representatives and vicarious agents is excluded. The liability for gross negligence and intent remains unaffected.
7. Storage of data / data protection
a. Bavaria Klassik stores and processes the data provided by the customer for the purpose of mutual contract fulfillment. A transfer of data to third parties will only take place if it is necessary for the fulfillment of the contract.
b. Bavaria Klassik may use the data for the purposes of its own market research and advertising. The customer can contradict this at any time without giving reasons with immediate effect.
8. Applicable law / foreign terms and conditions
All contracts subject to these General Terms and Conditions are governed exclusively by the law of the Federal Republic of Germany. Other terms and conditions are not valid.
9. Place of fulfillment / jurisdiction
Place of performance for all mutual obligations is Munich.
